A trademark is any sign — word, logo, slogan, shape, or combination — that distinguishes your products or services from those of others. Registering your trademark gives you the exclusive legal right to use it in commerce, prevents others from copying your brand, and creates a valuable business asset.
Critical: A trademark application that is accepted is published in the Trademark Journal for 4 months to invite oppositions. If an opposition is filed and not defended within the prescribed time, the trademark is refused — permanently. Monitor the journal actively and engage a professional the moment an opposition notice is received.
Check availability before filing
A comprehensive trademark search on the IP India database identifies identical or similar marks already registered in your class. We assess phonetic, visual, and conceptual similarity — and advise on the likelihood of registration and opposition.
Application in one or more classes
We prepare and file the trademark application in the correct class(es) under the Nice Classification system (45 classes covering goods and services). Filing can be done as an individual, MSME, or company — with different fee structures.
Defend your application
The Trademark Registry may raise an examination objection. Third parties can oppose your application within 4 months of journal advertisement. We prepare detailed legal responses to both objections and oppositions.
Protect for decades
A registered trademark is valid for 10 years from the filing date and can be renewed indefinitely in 10-year blocks. We track renewal dates and file renewal applications before expiry.
Any person or entity using (or intending to use) a mark in commerce can apply for registration.
Any individual — Indian citizen or foreign national — can apply for trademark registration for personal business or commercial use. Reduced government fees apply for individuals and MSMEs.
Private limited companies, public limited companies, LLPs, and Section 8 companies can register trademarks — with the entity as the trademark owner.
Partnership firms and sole proprietorships can register trademarks in the name of the firm or the proprietor. Ensure the applicant name matches actual business usage.
Foreign companies can file trademark applications in India — either directly or through Paris Convention priority (filing in India within 6 months of home country filing). India is a signatory to the Paris Convention.
Registration converts your brand from a marketing asset into a protected legal right.
Registration gives you the exclusive right to use the trademark across India in the registered class — preventing competitors from using identical or confusingly similar marks.
With registration, you can file an infringement suit in district court — and claim damages, injunction, and delivery up of infringing goods. Unregistered marks can only pursue passing off claims, which are harder to win.
Only registered trademark owners can use the ® symbol. The ™ symbol can be used without registration (indicating intent) but the ® symbol carries legal weight and deters infringers.
A registered trademark can be licensed to franchisees or distributors, or sold outright — generating revenue. It also enhances business valuation for investors and acquirers.
A registered trademark is the gateway to Amazon Brand Registry, Flipkart Brand Protection, and other e-commerce brand protection programs — preventing hijacking of your product listings.
After passing examination, your mark is published in the Trade Marks Journal. If unopposed for 4 months, registration proceeds — creating a public record of your exclusive rights.

Prepare Form TM-A with the trademark (word mark or device mark/logo), applicant details, class, and description of goods/services. For logos, upload the device in the required format.
File Form TM-A online on the IP India portal. Pay the government filing fee — ₹4,500 per class for individuals/MSMEs; ₹9,000 per class for companies. Receive application number immediately.
The Trademark Registry examines the application for absolute and relative grounds of refusal. If an objection is raised, an examination report is sent within 12–18 months of filing.
Prepare a detailed written reply to examination objections — citing use, distinctiveness, or differences from cited marks. An oral hearing before the Trademark Officer may follow.
If accepted, the mark is advertised in the Trade Marks Journal. After 4 months without opposition, the registration certificate is issued — valid for 10 years from the original filing date.
Documentation is minimal — trademark registration is primarily a legal and strategic process.
PAN of the individual, company, or firm applying for the trademark.
Identity proof of the applicant — Aadhaar for Indian applicants, passport for foreign nationals.
If claiming the concessional ₹4,500 fee as an MSME — Udyam Registration Certificate.
A single trademark application covers one class of goods/services. If your brand spans multiple classes (e.g., a clothing brand also selling footwear and bags), separate applications are required for each class — each with its own filing fee.
Registration is not the end — protect and enforce your trademark actively.
Actively monitor the monthly Trade Marks Journal for similar marks being published. You have 4 months to file an opposition — miss the window and the infringing mark gets registered.
Trademark registration expires after 10 years. Apply for renewal in Form TM-R within 6 months before expiry. Late renewal is possible with a surcharge — but lapsed marks can be picked up by others.
Send cease-and-desist notices to infringers. File a complaint with the police (criminal infringement under Section 103) or approach the district court for civil remedies — injunction, damages, delivery up.
An application still fails if you miss the opposition window during the 4-month journal publication — after that, refusal is permanent. We monitor the journal for you and respond the moment an opposition lands.
Prior trademark and common-law usage checked before filing to avoid objections and conflicting marks.
Your application tracked through the entire 4-month publication period so no opposition notice goes unnoticed.
Experienced counsel to draft and file your counter-statement within the strict response deadline.
